Terms of Service

1. The Service

The Service allows users to view and interact with features related to snow and ski destinations, including optional paid features. The Service is provided for entertainment and informational purposes only.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with permission of a parent or legal guardian.

3. Accounts

Some features may require you to create an account. You agree to provide accurate information, keep it up to date, and safeguard your account credentials. You are responsible for activities that occur under your account.

4. Privacy and Data

When you use the Service, we may collect personal information such as your name and email address (for example, when you sign up, sign in, or make a purchase). You consent to our collection and use of this information to provide and improve the Service, communicate with you, and comply with legal obligations.

5. Payments (Stripe)

If you choose to purchase paid features, your payment will be processed by Stripe. We do not store your full payment card details. Your use of Stripe is subject to Stripe's terms and privacy practices.

6. No Weather Guarantees; No Refunds for Snow Outcomes

Paying money does not increase the chances of snow. The Service does not control weather and does not guarantee that it will snow (or that any specific mountain or location will receive any amount of snowfall).

We do not reimburse payments if it does not snow. All purchases are final, except where a refund is required by applicable law.

7. Acceptable Use

You agree not to misuse the Service. For example, you will not: (a) violate any law; (b) attempt to access accounts or systems without authorization; (c) probe, scan, or test the vulnerability of the Service; (d) interfere with or disrupt the Service; (e) reverse engineer or attempt to extract source code except as permitted by law.

8. Intellectual Property

The Service and its content (excluding content you provide) are owned by the Company and its licensors and are protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.

9. Third-Party Services and Links

The Service may integrate with or link to third-party services (such as Stripe). We are not responsible for third-party services, and your use of them is at your own risk and subject to their terms.

10. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any information provided is accurate or complete.

11. Limitation of Liability

To the fullest extent permitted by law, the Company and its affiliates, officers, employees, agents, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of (or inability to use) the Service.

To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid to us for the Service in the 12 months before the event giving rise to the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its affiliates, officers, employees, agents, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service or violation of these Terms.

13. Suspension and Termination

We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms or if we need to protect the Service, users, or the public. You may stop using the Service at any time.

14. Changes to Terms

We may update these Terms from time to time. If we make material changes, we may provide notice by updating the effective date above or by other reasonable means. Your continued use of the Service after changes become effective means you accept the updated Terms.

15. Governing Law

These Terms are governed by the laws of the state and country where the Company is located, without regard to conflict of laws principles.
